Sublet Agreement Template

A sublet agreement template is basically an agreement provided by a tenant to a sub-tenant and it allows them to live on the same property owned by a single property owner. In this case, the tenant acts as the supervisor of the sub-tenant. Which basically means that they receive the rent from the sub-tenant and ensure the safety of the owner of the property. As, in this case, the tenant is the one responsible for the breaching of any rules or damage to any property. The homeowner or property owner is not associated with the sub-tenant in any way. The tenant is the one that has to pay the rent to the landlord according to their rental agreement. The tenant is the one that takes the rent from the sub-tenants and then he gives rent to the property owner.

A Common Example of a Sub-tenant:

A tenant rents out an apartment of three bedrooms, so he/she further rents out two of the bedrooms to sub-tenants. These sub-tenants are required to pay the rent of their individual bedrooms to the tenant and the tenant adds that money along with his/her part of the rent and pays it as the total rent to the property owner.

Content of a Sublet Agreement:

A sublet agreement is formulated in accordance to the original rental agreement signed by the tenant with some additional terms added by the tenant. This is done to save the owner of the property from any kind of violation. The sub-tenants are required to sign this agreement in order to start living on the property. Moreover, it includes the following factors:

1. The date of initiation of the agreement.

2. Proper identification of both parties, the tenant and sub-tenant.

3. The premises that will be permitted to the sub-tenant and for how long.

4. The amount of rent the sub-tenant is required to pay and how they will pay it.

5. The date on which the sub-tenant is expected to pay the rent. This date is usually a day or two before the actual rent has to be paid by the tenant.

6. The terms and conditions, rules and regulations, prohibitions and permissions, everything should be clearly mentioned in proper words to avoid any sort of misconceptions. These normally include sound limitations and keeping pets.

7. In case of any damage to the property, who will pay for the repair or the maintenance of the property? Usually, the tenant and sub-tenants mutually agree to pay their part in the maintenance if the landlord has already specified that they are not responsible for it.

8. The signature of the sub-tenants as well as the tenant.
